The Renters Rights Act has fundamentally changed the balance between landlords and tenants. Understanding your new rights — and documenting your tenancy properly from day one — is the most practical thing any UK renter can do.

The Renting Process — Step by Step

Search and shortlist

Rightmove, Zoopla, SpareRoom. Register with local letting agents — they often have properties before they go online. In competitive areas be ready to view and offer the same day.

View the property properly

Check boiler age and last service, water pressure (run all taps), phone signal, broadband availability, signs of damp behind furniture, and condition of all included appliances.

Pass referencing

Employment reference, previous landlord reference, credit check, income verification (typically 2.5 to 3× annual rent required). Guarantor may be accepted if you do not meet the threshold.

Read the tenancy agreement fully

Read every clause — break clause, pet and decorating permission, who pays utilities, landlord entry requirements, and any permitted rent increases.

Pay deposit and first month

Deposit capped at 5 weeks rent. Must be protected in DPS, MyDeposits, or TDS within 30 days of receipt.

Document everything at check-in

Video the entire property with running commentary. Photograph all pre-existing damage with dates. Email landlord inventory discrepancies within 24 hours of moving in.

What Landlords Cannot Charge

Under the Tenant Fees Act 2019 (England), landlords and agents cannot charge for viewings, administration, referencing, credit checks, tenancy renewals, or check-out fees. Only permitted: rent, security deposit (capped 5 weeks), holding deposit (capped 1 week), and specific default fees only.

⚠️ If Charged Illegally: Report to local Trading Standards. Tenants can recover all amounts charged. Fines up to £5,000 for first offence, £30,000 for repeat.

✅ Deposit Protection: If your landlord fails to protect your deposit within 30 days, you are entitled to 1 to 3 times the deposit in compensation — even if you get your full deposit back at the end.
