Outbound Desk service terms

Plain-English terms for the Outbound Desk service. These apply to every pack and trial. They are written to be read, not skimmed; if anything is unclear, ask before you order. Version 1.0, 9 September 2026.

1. Who we are

The service is provided by Kael Tripton Ltd, registered in England and Wales, company number 17177071, registered office 71-75 Shelton Street, London WC2H 9JQ, ICO registration ZC135439 ("we", "us"). You are the company ordering the service ("you", "the client"). The service is for business customers only.

2. What the service is

We build lists of senior contacts at UK limited companies, limited liability partnerships and public bodies matching a brief you approve; verify their work email addresses; write email sequences in your name which you approve before sending; send them from a mailbox or sending domain under your control or registered in your name; forward replies to you; and report on results. The number of contacts, sequences and mailboxes depends on the pack you buy. The service is email only.

3. What the service is not

We do not sell, licence or hand over contact lists. We do not promise or guarantee any number of deliveries, opens, replies, meetings or sales; results depend on your offer, your market and factors outside our control. We do not email consumers, sole traders or partnerships. We do not act as your sales team, negotiate on your behalf, or make representations to prospects beyond the approved email copy.

4. Your responsibilities

You confirm that: your company is genuine and lawfully trading; you have the right to sell what you ask us to promote; the information you give us about your product is accurate and not misleading; your product or service can lawfully be marketed to UK businesses; you are not, and your target companies are not, subject to UK sanctions; and you will tell us if any of this changes. You approve every list and every email before we send. You will honour any opt-out we pass to you in your own systems and will not contact anyone we report as opted out. You will not ask us to send to any list you supply unless it passes the same checks as our own lists.

5. Regulated products and prohibited uses

We may decline or stop any campaign that in our judgement promotes: financial products or services that would constitute a financial promotion requiring approval by an FCA-authorised person; medical, health or pharmaceutical claims; gambling; cryptoassets; adult content; weapons; anything unlawful in the UK or in your own country; or anything we consider likely to damage the reputation of the sending domain or of Kael Tripton. Fees already paid for work already done are not refunded in these cases.

6. Data protection and marketing law

Campaigns are run under UK law: the Privacy and Electronic Communications Regulations 2003 and the UK General Data Protection Regulation, as amended. We source business contact data from licensed providers and hold it as a data controller under our own legitimate interest assessment. You are the data controller for the campaign run in your name. Each of us is responsible for our own compliance; this is a controller-to-controller relationship, not a processor arrangement. Every email identifies you as sender with your legal name, registration number, registered office, an opt-out mechanism and a link to privacy information. Opt-outs and objections are recorded on a suppression list that we check before every send and share with you at the end of each pack. Clients outside the UK remain responsible for any law that applies to them in their own jurisdiction.

7. Sending domains and mailboxes

Where we register a sending domain for you, it is registered in your company's name and you own it; we hold administrative access for the duration of the service. We do not send from your primary business domain. Mailbox and domain costs are passed through at cost. Deliverability depends on factors including the recipient's mail provider and the content you approve, and cannot be guaranteed.

8. Fees, payment and term

Prices are in pounds sterling and exclude VAT, which is added where applicable. The Trial is paid in advance and is refundable in full only if cancelled before list building begins. Monthly packs are paid in advance each month. Setup fees are payable once per client and are not refundable once work has begun. Starter renews monthly and can be cancelled at any time before the next billing date. Growth and Scale have a minimum of two months, then renew monthly. Unused contacts do not roll over. We may change prices for future periods with 30 days' notice.

9. Ownership

You own the email copy we write for you once paid for, the sending domain registered in your name, and the campaign records we deliver: contacts reached, outcomes, replies and the suppression list. We keep our research, methods, templates and any data not delivered to you.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited. Subject to that, our total liability to you for all claims arising under or in connection with the service in any 12-month period is limited to the fees you paid us in that period, and we are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss. You will compensate us for claims arising from information you supplied, products you asked us to promote, lists you supplied, or your failure to honour opt-outs in your own systems.

11. Suspension and termination

We may suspend or end a campaign immediately if we receive a regulatory enquiry or a credible complaint about it, if a sending domain's reputation is at risk, or if you breach these terms. Either party may end the service on 30 days' notice after any minimum term. On ending, we deliver the campaign records for work completed and delete undelivered prospect data in line with our retention policy.

12. Complaints and contact

Complaints about a campaign, including from recipients, go to privacy@kaeltripton.com and are acknowledged within two working days. Service questions go to sales@kaeltripton.com.

13. Law

These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction. These terms are a summary of our standard client agreement; where you sign a client agreement, that agreement prevails.
