What happens if you do not pay Council Tax

The recovery sequence is fixed by the Council Tax (Administration and Enforcement) Regulations 1992 and applies to every English billing authority. A missed instalment triggers a 7-day reminder; if you do not pay within seven days, the next instalment and the missed one are both due together.

A second missed reminder cancels your right to pay by instalments: the whole year balance becomes payable immediately, followed by a 14-day final notice. After the final notice, the council applies to the magistrates' court for a liability order. The hearing is short and does not consider ability to pay.

Scotland uses a different procedure: a summary warrant from the sheriff court, granted without a separate hearing, with sheriff officers (rather than enforcement agents) recovering the debt.

Liability orders and enforcement agents

Once a liability order is in place, the council can use enforcement agents (formerly bailiffs) to recover the debt. Enforcement agent fees are added on top: a £75 compliance stage fee, plus £235 (plus 7.5 per cent of any debt over £1,500) for the enforcement stage, plus £110 for the sale or disposal stage. The fees are statutory and cannot be negotiated by the agent.

Alternative enforcement routes are attachment of earnings (deductions taken by your employer), attachment of benefits (deductions taken from Universal Credit or similar), charging order against the property, and (rarely) committal or bankruptcy proceedings.

The Tribunals, Courts and Enforcement Act 2007 governs enforcement agent conduct, including what they can and cannot take, when they can enter the property, and what safeguards apply for vulnerable households.

Is not paying Council Tax a criminal offence

Not paying Council Tax is not itself a criminal offence. It is a civil debt, recovered through the magistrates' court via a liability order and then through enforcement agents or attachment of earnings or benefits.

However, if you have a liability order and the council has tried enforcement agents without success, the council can apply to the magistrates' court for a committal hearing. At committal the court can send you to prison for up to three months, but only if it finds that you have the means to pay and are wilfully refusing. Committal is rare.

Lying to the council about who lives at the property, or fraudulently claiming a discount or exemption you are not entitled to, can be prosecuted under the Fraud Act 2006. That is a criminal offence; the underlying non-payment is not.

How to stop enforcement: payment plans and Breathing Space

The most reliable way to stop enforcement is to engage with the council before it goes to court. A payment plan agreed before the summons is usually enough to withdraw or adjourn the case. After a liability order, a payment arrangement can still be made, but the order remains in place as a precondition for further enforcement if you default.

Breathing Space (the Debt Respite Scheme) gives 60 days of legal protection from creditor action, including Council Tax enforcement, while you work with a regulated debt adviser. A separate Mental Health Crisis Breathing Space lasts as long as you are receiving treatment for a mental health crisis, plus 30 days afterwards.

Free independent advice is available from Citizens Advice, National Debtline and StepChange. Their advisers can speak to the council on your behalf with your written authority and can negotiate an affordable payment arrangement.

Where to get further help and how to escalate

If the council cannot resolve your Council Tax issue through its own complaints process, you can escalate to the Local Government and Social Care Ombudsman, an independent body that investigates complaints about local councils. The Ombudsman is free to use and does not require legal representation.

For independent debt advice on Council Tax arrears, free help is available from Citizens Advice (national phone line, webchat and in-person service), National Debtline (free phone line and webchat run by the Money Advice Trust) and StepChange (free phone line and online advice). All three can speak to the council on your behalf with your written authority.
